MotionHarbor AI respects your privacy. This Policy explains what information we collect, why we use it, when it may be disclosed, and the choices available to you when you use our mobile application, website, and related services (collectively, the “Service”).

1. Scope and responsibility

This Policy applies to information processed by MotionHarbor AI (“MotionHarbor,” “we,” “us,” or “our”) through the Service. It does not govern a third party’s independent practices, including an app store, device platform, linked website, advertising partner, or AI service provider. Their handling of information is governed by their own terms and policies.

By using the Service, you acknowledge the practices described here. If you do not agree, do not use the Service.

2. Information we collect

2.1 Information you provide

  • Account and contact information. If account features are available, we may receive your account identifier, display name, email address, authentication token, and related profile details. We also collect information you include in support requests or feedback.
  • Prompts and creative inputs. We process text prompts, images, photos, settings, and other materials you submit to create or edit content.
  • Generated content. We process images, video, generation history, and related metadata created through the Service so we can display, save, or deliver results to you.
  • Transaction information. Purchases and subscriptions are processed by Apple App Store, Google Play, or another authorized payment platform. We may receive product identifiers, subscription status, purchase tokens, transaction identifiers, currency, and limited receipt information. We do not receive your full payment-card number.

2.2 Information collected automatically

  • Device and network data. Device model, operating-system and app version, language, time zone, country or approximate location inferred from IP address, screen size, network type, device or advertising identifiers where permitted, and IP address.
  • Usage and diagnostics. App launches, pages or features used, interaction events, generation status, timestamps, crash reports, performance data, error logs, and security or fraud signals.
  • Website data. When you visit this website, standard server logs may record IP address, browser type, referring page, requested URL, and time of access. This static website does not intentionally set first-party advertising cookies.

2.3 Device permissions

Depending on the feature and your device, the app may request access to your camera, photos or media library, storage, notifications, or network connection. We use a permission only for the feature described when it is requested—for example, camera access to capture an image or photo-library access to select and save media. You can manage permissions in your device settings. Disabling a permission may prevent the related feature from working.

3. How we use information

We use information as reasonably necessary to:

  • provide image generation, video generation, background removal, templates, storage, history, and other requested features;
  • process prompts and uploaded media through our infrastructure and AI service providers;
  • authenticate users, maintain accounts, verify purchases, restore entitlements, and provide subscriptions or virtual credits;
  • operate, troubleshoot, analyze, personalize, and improve the Service;
  • respond to questions, feedback, privacy requests, and customer-support messages;
  • detect abuse, secure the Service, enforce our Terms, and prevent fraud or illegal activity;
  • send operational communications, such as security, transaction, policy, and service notices;
  • show, measure, or limit advertising where an ad-supported version is available and applicable law and your settings permit it; and
  • comply with law, resolve disputes, and protect users, the public, and our legal rights.

Where required, our legal bases include performing our contract with you, our legitimate interests in operating and securing the Service, compliance with legal obligations, and your consent.

We do not use your private uploads to train our own general-purpose AI models unless we first provide clear notice and obtain any consent required by law. External AI providers may process content under their own service terms and our arrangements with them.

4. How we disclose information

We may disclose information in the following circumstances:

  • Service providers. Hosting, cloud storage, content delivery, AI generation and moderation, analytics, crash reporting, customer support, email, fraud prevention, and security providers process information for us.
  • Platform and payment providers. Apple, Google, and authorized commerce providers process app distribution, purchases, receipts, refunds, and subscriptions.
  • Advertising and analytics partners. If advertising or measurement features are enabled, partners may receive device, advertising, approximate-location, and interaction data, subject to your consent and device settings where required.
  • Legal and safety purposes. We may disclose information when reasonably necessary to comply with law or legal process; respond to lawful government requests; protect a person’s safety, rights, or property; investigate fraud; or enforce agreements.
  • Business transfers. Information may be transferred in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of all or part of our business, subject to appropriate safeguards.
  • At your direction. We disclose information when you direct us to share or publish content, or when you use a third-party sharing feature.

Partners that may process information, depending on app version and feature availability, include cloud and AI generation providers, Apple App Store, Google Play, Google services such as Firebase or AdMob, and other providers identified in the app or consent interface. We do not sell personal information for money. Certain advertising disclosures may be considered a “sale,” “sharing,” or targeted advertising under some privacy laws; applicable opt-out rights are described below.

5. Your choices and controls

  • Permissions: manage camera, photos, storage, and notification access in device settings.
  • Advertising identifiers: reset or limit your device advertising identifier and ad personalization through iOS or Android settings.
  • Notifications: disable app notifications in device settings.
  • Subscriptions: manage or cancel through the app-store account used to purchase. Deleting the app does not cancel a subscription.
  • Local history: use in-app controls, where available, to delete generated items or account data.
  • Marketing: use an unsubscribe link in marketing email or contact us. Operational messages may still be sent.

6. Data retention

We retain information only as long as reasonably necessary for the purposes described in this Policy, including to provide the Service, maintain generation history, fulfill transactions, comply with law, resolve disputes, prevent fraud, and enforce agreements. Retention varies by data type, sensitivity, user settings, and legal requirements.

Prompts, uploaded media, and generated content may be retained while needed to complete a request and, if history or cloud-save features are enabled, until you delete them or your account. Temporary files may remain in encrypted backups or provider systems for a limited period before deletion. We may retain de-identified or aggregated information that cannot reasonably identify you.

7. Security

We use administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, and disclosure. No internet transmission, AI processing pipeline, or storage system is completely secure. You are responsible for protecting your credentials and for avoiding uploads that contain information you do not want processed.

8. International transfers

MotionHarbor and its service providers may process information in countries other than the one where you live. Those countries may have different data-protection laws. Where required, we use recognized transfer mechanisms and safeguards, such as standard contractual clauses, adequacy decisions, or your consent.

9. Your privacy rights

Depending on where you live, you may have the right to request access to, correction of, deletion of, or a portable copy of personal information; restrict or object to processing; withdraw consent; opt out of targeted advertising or certain disclosures; and appeal a decision on a privacy request.

To submit a request, email kosterj803@gmail.com with the subject “MotionHarbor AI privacy request.” Describe the right you want to exercise and the account or device information reasonably needed to locate your records. We may verify your identity and authority before acting. Authorized agents may submit requests where permitted by law.

You may also complain to your local data-protection authority. Withdrawing consent does not affect processing already performed lawfully.

10. Regional notices

EEA, United Kingdom, and Switzerland

For users in these regions, we process personal data under the legal bases identified in Section 3. You may contact your local supervisory authority and may exercise the rights described in Section 9. Where we rely on legitimate interests, those interests include providing, improving, securing, and measuring the Service.

California and other U.S. states

Depending on applicable law, residents may request the categories and specific pieces of personal information collected, sources, business purposes, categories of recipients, correction, deletion, or portability, and may opt out of sale, sharing, targeted advertising, or certain profiling. We will not discriminate against you for exercising a legal privacy right.

In the preceding 12 months, the categories described in Section 2 may have been collected and disclosed for the business purposes described in Sections 3 and 4. We do not knowingly sell or share the personal information of consumers under 16.

Do Not Track

Because there is not yet a uniform industry standard, the website does not currently respond to browser “Do Not Track” signals. Where legally required and technically supported, we honor recognized opt-out preference signals for the browser or device that sends them.

11. Children’s privacy

The Service is not directed to children under 13, or a higher minimum age where local law requires it. We do not knowingly collect personal information from a child below the applicable age. If you believe a child has provided personal information without valid parental consent, contact us so we can investigate and delete it as appropriate.

12. Changes to this Policy

We may update this Policy to reflect changes in the Service, law, or our practices. We will post the updated version here and change the effective date. If a change is material, we may provide additional notice in the app or by other appropriate means. Your continued use after the effective date is subject to the updated Policy.
