These Terms of Use (“Terms”) govern your access to and use of the MotionHarbor AI mobile application, website, and related AI creation services (collectively, the “Service”). Please read them carefully before creating, uploading, or purchasing anything.

1. Agreement to these Terms

By downloading, accessing, purchasing through, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you have authority to bind it, and “you” includes that organization.

The Service uses generative artificial intelligence. Outputs can be inaccurate, unexpected, similar to content produced for others, or unsuitable for your intended use. You must review every output before using or publishing it.

2. Eligibility and accounts

You must be at least 13 years old—or the minimum digital-consent age in your country—to use the Service. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you. The Service is unavailable where its use is prohibited by law.

If an account is required, you must provide accurate information, keep credentials confidential, and promptly notify us of unauthorized access. You are responsible for activity under your account to the extent permitted by law. You may not sell, transfer, or share an account in a way that compromises the Service.

3. The Service

MotionHarbor provides tools that may include text-to-image generation, image-to-video generation, image editing, background removal, templates, creation history, saving, subscriptions, and virtual credits. Features, models, output formats, generation times, limits, and platform availability may change.

We may apply technical limits, queues, watermarks, content filters, credit costs, or usage caps. We do not guarantee that a feature, model, template, or generated item will remain available. You are responsible for the device, internet access, and compatible software needed to use the Service.

4. Your content and permissions

“Your Content” means prompts, images, photos, video, text, feedback, and other material you upload or submit, excluding the Service itself.

4.1 Your ownership

As between you and MotionHarbor, you retain the rights you already hold in Your Content. These Terms do not transfer ownership of Your Content to us.

4.2 License needed to operate the Service

You grant MotionHarbor a worldwide, non-exclusive, royalty-free license to host, copy, transmit, modify, display, and otherwise process Your Content solely as reasonably necessary to operate, secure, improve, and provide the Service; create your requested outputs; comply with law; and enforce these Terms. This license lasts while Your Content is stored or processed, plus a reasonable period for backups, legal compliance, fraud prevention, and dispute resolution.

4.3 Your promises

You represent that you have all rights, permissions, and consents necessary to submit Your Content and allow the processing described above. This includes consent from identifiable people where required and rights to copyrighted material, trademarks, faces, voices, private data, and other protected elements. Do not upload confidential material unless you are authorized to have it processed by AI services.

4.4 Feedback

If you send ideas or feedback about the Service, you grant us a perpetual, worldwide, irrevocable, royalty-free license to use it without restriction or compensation, provided we do not publicly identify you without permission.

5. AI-generated outputs

5.1 Rights in outputs

To the extent permitted by applicable law and subject to these Terms and third-party rights, we assign to you any rights we may have in outputs generated specifically for you. The law may not recognize copyright or exclusive rights in AI-generated material. Outputs may not be unique, and other users may receive similar or identical material.

5.2 Your responsibility

You decide whether and how to use an output. Before publishing, selling, or relying on one, you must evaluate it for accuracy, safety, originality, legality, bias, and third-party rights. Do not represent AI-generated content as human-made where disclosure is required. You are responsible for labels, consents, clearances, and licenses required for your use.

5.3 No professional advice

Outputs are not legal, medical, financial, safety, or other professional advice and should not be relied on as such. The Service is not designed for high-risk decisions or uses where error could cause injury, discrimination, or material harm.

6. Acceptable use

You may not use the Service, attempt to use it, or help another person use it to:

  • violate a law, regulation, court order, contract, or third-party right;
  • create or distribute child sexual abuse material, sexual content involving minors, or content that exploits or endangers a child;
  • create non-consensual intimate imagery, sexual deepfakes, or sexualized depictions of a real person without valid consent;
  • impersonate, defraud, deceive, harass, stalk, threaten, defame, or facilitate violence or discrimination;
  • create deceptive political or public-interest content without legally required disclosures, or interfere with elections and civic processes;
  • identify or infer sensitive personal information, conduct biometric surveillance, or make high-impact decisions about people;
  • infringe copyright, trademark, privacy, publicity, confidentiality, or other rights;
  • introduce malware, overload systems, bypass access controls or safety filters, probe vulnerabilities, scrape at scale, reverse engineer except where law permits, or access the Service through unauthorized automation;
  • resell or provide the Service to others except under a separate written agreement; or
  • use outputs or the Service to develop or train a competing model or service where prohibited by applicable law or third-party terms.

We may use automated and human review to detect suspected violations. We may block prompts or outputs, remove content, limit features, suspend accounts, preserve relevant evidence, or report activity when reasonably necessary for safety or legal compliance.

7. Purchases, subscriptions, and virtual credits

7.1 App-store billing

Purchases may be processed by Apple App Store, Google Play, or another authorized platform. Its payment terms, taxes, refund rules, and account requirements also apply. Prices and included features are shown before purchase and may vary by region.

7.2 Auto-renewing subscriptions

If you purchase an auto-renewing subscription, it renews for the disclosed period unless canceled through the applicable app-store settings before renewal. The store charges your account. Deleting the app or account does not automatically cancel a subscription. After cancellation, access generally continues through the paid period. Any free trial converts to a paid subscription unless canceled before the trial ends.

7.3 Virtual credits and rewards

Gems, credits, rewards, or similar units are limited, revocable licenses to access designated Service features. They have no cash value, are not property or legal tender, are non-transferable, and cannot be redeemed for money except where law requires. We may change credit costs, earning methods, expiration, or availability. Purchased credits are handled under applicable store rules and law.

7.4 Refunds and price changes

Unless law requires otherwise, transactions are final and non-refundable. Submit store-billed refund requests to the relevant app store. We may change future prices or plans with notice required by law; changes do not retroactively alter a completed purchase.

8. MotionHarbor intellectual property

The Service—including its software, interface, branding, logo, templates, graphics, compilation, and documentation—is owned by or licensed to MotionHarbor and protected by intellectual-property laws. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

You may not copy, modify, distribute, sell, lease, sublicense, publicly display, or create derivative works from the Service itself unless we authorize it or law permits it. “MotionHarbor AI” and related branding may not be used in a way that suggests endorsement or affiliation without written permission.

9. Third-party services

The Service may rely on or link to third-party AI providers, hosting, app stores, advertisements, analytics, websites, or sharing tools. We do not control their services or content and are not responsible for their independent acts. Your use may be subject to their terms. Links are provided for convenience and do not imply endorsement.

10. Suspension, termination, and deletion

You may stop using the Service at any time and may request account deletion where available. You remain responsible for canceling active subscriptions through the store.

We may restrict, suspend, or terminate access, remove content, or discontinue all or part of the Service if we reasonably believe you violated these Terms, created legal or security risk, failed to pay, abused the Service, or if continued operation is impractical. Where appropriate, we will provide notice and an opportunity to appeal.

Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute terms—will survive.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MOTIONHARBOR DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT OUTPUTS WILL BE UNIQUE, ACCURATE, LAWFUL, OR SUITABLE; THAT DEFECTS WILL BE CORRECTED; OR THAT CONTENT WILL NOT BE LOST. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTIONHARBOR AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS; OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MOTIONHARBOR THROUGH THE SERVICE IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US$50.

These limits do not apply where prohibited and do not limit liability that cannot legally be limited, including liability for fraud or willful misconduct. Your jurisdiction may provide additional rights.

13. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless MotionHarbor and its affiliates, personnel, licensors, and service providers from claims, damages, losses, and reasonable costs (including legal fees) arising from Your Content, your use of outputs, your violation of these Terms or law, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

14. Governing law and disputes

Before filing a formal claim, you and MotionHarbor agree to try to resolve the dispute informally for 30 days. Send a written description of the dispute and requested resolution to kosterj803@gmail.com. This does not prevent either party from seeking urgent injunctive relief or using a small-claims procedure where available.

These Terms are governed by the laws applicable in the jurisdiction where the Service operator is established, without regard to conflict-of-law principles, except that mandatory consumer protections in your home jurisdiction remain applicable. Courts with lawful jurisdiction over the operator will hear disputes, unless applicable consumer law allows you to bring a claim in your home courts.

If any term is unenforceable, it will be modified only as much as necessary and the remaining terms remain in effect. Our failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the Service.

15. Changes to the Service or Terms

We may modify the Service and these Terms. We will post updated Terms and revise the effective date. If changes are material, we may provide additional notice. Unless stated otherwise, changes apply when effective. If you do not agree, stop using the Service. Continued use after the effective date means you accept the updated Terms to the extent permitted by law.
